The LCA process is the same for every state, under the new iCert LCA system. Approval can take 2 weeks, or longer if DOL does not recognize the EIN, which is very common.

This would be a limited portability - AC21. Correct? I'm saying approved I-140 for all practical purposes should serve like a temp GC. Maybe this is far fetched!!!

It wouldn't hurt your GC process or your status even if your employer revokes your approved I-140. If you are so worried then check this info from USCIS - http://www.uscis.gov/files/pressrelease/I140_AC21_8403.pdf

Hello - I have a unique situation. I'm currently in the US on H1B, and my fiance is in India working for a reputed software company. We are planning to get married by end of April.
I want her to come to US on a work visa (hopefully H1B). I got to know that to make the FY09 H1B cap, she has to apply for H1B on Apr 1 2008, and wait till Oct 1 to travel if her visa gets approved. But since we are getting married by end of April, I don't want her to stay in India till October while I'm here.
The other option I was thinking was to apply for her H1B on Apr 1, but still go ahead and apply for H4 in early May, so that she can travel on H4 in May. And once her H1 is approved, she would already be in the US and can start working from Oct 1. Is this possible? Will this plan create any problems for her H4 or H1 visa application?
If the above does not work, what are my other options? If I miss the Apr 1 2008 deadline, the next earliest she can apply for H1 is Apr 1 2009, and work from Oct 1 2009 - and I don't want to wait that long.
Another option is to get married before Apr, get her to US on H4 before Apr, and apply for change of status to H1 on Apr 2008. But the marriage plans for Apr is made and to push the dates back would not be easy.
Any help in this matter is appreciated.

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

Just curious to know whether anybody received the physical card with out a CPO email or status. Did anybody with just "Welcome" email and status receive cards yet?
Just checking whether NO CPO status/ email = no card.
I received the "Welcome" email, status and the physical letter on Tuesday but no card yet. Any body in the same boat? (I understand that it takes about 1-3 weeks but many have received cards with in a week)
The reason I am asking is my I9 expires month end and HR is on my back for the updated doc. They would rather see a card than a letter which has no expiration date :)
Stop worrying the CPO email is not essential. I am living proof. Never received that particular email but did get welcome notice and green cards. Be careful opening your mail. The cards come in a VERY generic white window envelope and could easily be discarded as junk mail so open every envelope you get for now.

Another question I had was about LUDs. I did my FP on Oct-29-07 on which date I also noticed an updated LUD (from Sep-25 to OCT-29).
However, on Oct-31, I noticed that the LUD was updated yet again to OCT-30.
Any idea what this could mean?

If this has happened to you personally then you may be able to let Ombudsman know about it.
if it has happened to a friend of yours then maybe you can convince the friend to complain to Ombudsman.
Beyond this I doubt there is much that can be done.
