Hello Folks,
I am on H1-B and have an EAD. My Dad is a builder in Hyderabad and I want to promote the apartments in US. Can I rent an office space and just do marketing without registering a business? All sales will be completed in India.

Hi,
I am on H1, Applied EAD and Travelling on AP.
Is there a problem if I don't have approved EAD while I come back?
Please note EAD has nothing to do with travel.
EAD is authorization to work while adjusting your status.
AP is advance paroled document which you require when AOS is pending, you will be admitted in as parolee.

I think TSC is strictly screening all applications so that it will not be burdened by too many cases including incomplete application to be processed. Therefore, in the long run, TSC will be faster in approving or denying cases.

I was checking the availabiltiy of dates for H1 stamping and came up with following question..
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*
My wife came to USA on H4 and recentlly moved to H1.... We are planning to get her visa stamped...now my Q is same class of Vsia means any H visa like H1,H4 falls under H class of Visa...
OR
they refering to H1 visa as one class and H4 visas under another class??

Mine got approved exactly 2 months and a week. The lawyer sent me a copy of I-140 that was sent to USCIS and that covered my Labor certification also.

I used the AR-11 form for the change of my address. I did it online. Also, while changing there is an option to change the address for any pending petition. In my case it is the I-485, which I changed.
My question is, how to verify if the address has actually changed in the system at USCIS. I checked my case status online and did not see any LUD's.
Please let me know if anyone of you have done the change of address and share your experience.

Call the 1-800 number and navigate to an rep via the POJ method.. You can verify you address with them.

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

I recently got my I140 approved and I am waiting to file my I485 as my priority date(Oct 2007) is still not current(EB2 category, India).Not sure how long it is going to take as the current backlog is July 2000 for India and China.
My brother is a citizen of the US and I need to clarify if my brother can apply for a family-based green card for me and how long does it take to get the EAD when applied through this process as compared to filing through the employer when I reach my priority date.
Also need to clarify if this process is sooner or still the same as applying through the employer.

My 485 case is pending under EB3 category but my employer has already filed for EB2 labor which got approved and now I want to know if I can apply I140 for EB2 to interfile under 'Premium' Category? Are there any restrictions on applying I140 under premium processing?

Can anyone tell me after my 6th year of H1 i have a 3 year extension of h1 visa, can i go to india and come back on that visa or do i need to have AP. I got my 140 approved and i got my 485 receipt notices.
you can use the visa, need not use AP if you dont want to. If you have a visa stamping already, using the H1 visa is the preferred way to return:
- you get an I-94 valid for 3 more years (with AP you get one for just one year, which is a bit weird)
- using AP atleast sometimes pushes you into secondary inspection which is another hour spent with the customs and border patrol folks. While they are typically nice and friendly, I personally hate being stuck in that no-mans land at the airport.
Only advantage of AP is if your GC is approved while you are abroad, you are supposed to return on AP as your H1 status would have ended. in practice people have re-entered on H1 in such cases and its been ok. Depending on your PD this may not may not be a concern

On May 18, 2009, the Texas Senate passed a bill requiring Sheriffs or any other officers in charge of a correctional facility, to determine the “citizenship status” of all convicted felons. The bill, S.B 2584, amends Chapter 2, Code of Criminal Procedure, by adding Article 2.245. If a defendant has been convicted of a felony under Title 5 (Offenses Against the Person), Penal Code, Title 6 (Offenses Against the Family), Penal Code, Title 7 (Offenses Against Property), Penal Code, Chapter 43 (Public Indecency), Title 9 (Offenses Against Public Order and Decency), Penal Code, Chapter 45 (Weapons), Title 10 (Offenses Against Public Health, Safety, and Morals), Penal Code, and Chapter 481 (Texas Controlled Substances Act), Health and Safety Code, the sheriff or officer will make a reasonable effort to determine the defendant’s “citizenship status”. If the sheriff has reason to believe the defendant is a foreign national, within 48 hours after the defendant is received at the correctional facility, the sheriff or officer will contact the Department of Homeland Security (DHS) to verify the defendant’s immigration status. My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.

it's more Marketing rubbish..
certainly it'll be a better 6MP image than before, but it won't have the pure resolution of a 1Ds or 14N.
Dynamic Range will be nice, but doesn't tip it over the edge. Why don't they go bigger in MP? One might ask.... I think they're finding it tough.. Somehow Canon has nailed it. Kodak couldn't.
Interesting times ahead!!

I want to keep this thread on top for a while to see how many People with priority date between Jan'05 and March 28th '05(Filed under RIR/NON-RIR) applied again in PERM. The reason is lot of Friends i know applied their labor again in PERM since the Old Labors filed under RIR were sent to BEC Center's in Phily and Dallas for 'cold storage' and forgot to port the dates after the old labor approval since the time regained was not big enough.
This gives us an fairly good idea to see how quickly the dates would move from Jan' 22nd '05 as many fear there might a huge figure here who applied between December '04 and March 28th '05 under the old process and before PERM kicked in .
Please do not forget to mention if you have ported the dates from your old labor.

My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? If yes, what will my sponsor company need to be succesful with this appealing ?
